The legislation which came into force in England on 1 July 2007 protects people from the harmful effects of secondhand smoke in enclosed public places and workplaces. Secondhand smoke from cigarettes, cigars, pipes and shisha pipes is harmful. As a result shisha pipes are treated the same in the legislation as other smoking products.
This is in line with international evidence and recommendations. The World Health Organization (WHO) advises that:
"using a water pipe to smoke tobacco poses a serious potential health hazard to smokers and others exposed to the smoke emitted"
It also states:
"second-hand smoke from water pipes is a mixture of tobacco smoke in addition to smoke from the fuel, and therefore poses a serious health risk for non-smokers"
The WHO advice concludes:
"water pipes should be prohibited in public places consistent with bans on cigarette and other forms of tobacco smoking. "

The legislation, which came into force on 1 July 2007, does not prevent smoking of shisha pipes or other products in non-enclosed public places and workplaces, such as outside area of cafes, nor does it prevent smoking of shisha pipes or other products in private homes.

Petition the Prime Minister to exempt shisha and hookah cafes from the smoking ban in England & Wales that will be coming into force in July 2007.
Shisha cafes are different to pubs, restaurants, and other public places which are to be affected by the smoking ban in England and Wales, because of the simple fact that the sole reason of going to a shisha cafe, is for social smoking with friends and family. Non smokers do not go to shisha cafes. To ban shisha cafes from operating is not only to remove an integral, uniting, and contributory part of middle eastern and arabic culture from British society, but also to effectively remove the attraction and appeal of these areas (such as Edgware Road in London), thus having an added significant detrimental effect to the majority of local businesses situated within the local area who are not involved in the shisha smoking business, but who depend on this attraction to draw people to the local community. Help the local businesses, help the community, and help those who believe that the government is forcing regulation in a sector that is essentially a matter of choice and personal taste.
